In accordance with The Texas Education Code, Chapter 44 - Fiscal Management, Section 031 - Purchasing Contracts, Ernest Educational Concepts (EEC) has determined that it qualifies as a business entity that is exempt from the competitive bid process under paragraph 44.031(j) which states:

  (j) Without complying with Subsection (a), a school district may purchase an item that is available from only one source, including:

     (1) an item for which competition is precluded because of the existence of a patent, copyright, secret process, or monopoly;

The EEC program was developed in house, all materials, activities and concepts are unique and copyrighted to EEC (there is also a patent pending on manipulative aids), and cannot be provided by any other vendor that EEC is aware of.
